PURITY BRIDGE SURGERY TERMS AND CONDITIONS
These are the Terms & Conditions on which we (Purity Bridge) supply Services to you. “Services” refers to surgical and medical procedures that take place at Purity Bridge (the trading name of Tunbridge Wells Plastic Surgery Ltd, company number 08226611).
Purity Bridge will provide a quote setting out the Services and the facility fees that will be required for your surgical or medical procedure. We will also provide a quotation from the anaesthetist if appropriate, and your surgeon (if requested to do so by prior agreement between you and your surgeon). Usually, your surgeon will provide a quotation for their surgical fee separately. Those quotes together form the “Fixed Quotation”. The Fixed Quotation will remain fixed for 60-days, subject to clinical pre-assessment.
General Terms:
The Fixed Quotation we offer you is only valid once you have received it in writing. It is valid for 60-days from the date of issue by your consultant and will be sent following satisfactory consultant assessment.
Purity Bridge and your consultant must be satisfied that you do not have any pre-existing medical conditions or other factors that are likely to give rise to complications or the need for additional treatment. Before confirming your admission, you will be required to complete an on-line pre-assessment questionnaire at least 2-weeks prior to your surgery date to establish that we are able to treat you at Purity Bridge, and whether or not further pre-operative tests are required (which will be charged for separately and in addition to the price set out in the Fixed Quotation). Failure to complete the on-line questionnaire within the required time frame may result in the cancellation of your surgery and the loss of your paid facility fee.
Our Fixed Quotation for the procedure will not change during the 60-day period referred to above, but we reserve the right not to provide treatment if it is not clinically appropriate for us to do so, in which case we will either rearrange the date for your procedure (if appropriate) or cancel your procedure. If we have to cancel your procedure due to failure by you to provide relevant or correct information, we will retain any deposits or facility fees you have paid, otherwise we will refund you fees for Services which have not been provided.
You will be required to pay in full for your treatment at least 4-weeks before your procedure.
You can pay by BACS transfer, credit or debit card. No refund will be given if you decide not to proceed with the treatment within 24 hours before your planned treatment, refunds for cancellation before that point are set out below. You will not be able to proceed with your procedure until we have received payment in full in advance.
Cancellation charges:
- For an early cancellation (more than 28 days before planned treatment) a full refund of the facility (clinic) fee will be given.
- For a cancellation between 28 and 14 days of the planned treatment, a cancellation fee of 50% of the total facility (clinic) fee will apply.
- For a cancellation between 14 days and 24-hours of the planned treatment, a cancellation fee of 75% of the total facility (clinic) fee will apply.
- In the circumstances above, refunds of any other fees (such as independent practitioners) not directly imposed by Purity Bridge (but which may be collected or invoiced by us in their behalf) will be subject to the cancellation and refund policies of the relevant independent practitioners.
- If you cancel within 24-hours of planned treatment or do not attend the clinic at the correct time, you will be liable for the full charge.
- If, following on-line pre-assessment, it is determined that medical investigations are required (for example blood tests or heart tracings (ECG)), separate charges may be made for the specific tests indicated (in addition to the Fixed Quotation). Please refer to our price list for additional tests, which is available on request.
- If, following pre-assessment, your consultant determines it is not suitable to proceed with treatment, a full refund will be given.
We will make every effort to provide the Services on the date that we have specified. However, we cannot promise this, and we reserve the right to refuse your admission or to cancel or change the date of your admission. There may be delays or cancellations for any reason, such as because of an event outside our reasonable control, for operational or technical reasons or because your consultant does not think it is in your best interest for medical reasons. If this happens, we will give you as much notice as possible. Where possible, as appropriate, we will always try to rearrange any appointment or admission dates with you. Where we are required to cancel the appointment or refuse admission, any advance payment for Services that have not been provided will be refunded to you. We will refund these amounts by cheque or electronic transfer only to the cardholder or person who made the original payment. Should we reschedule your operation we will not raise further charges for pre-operative assessment or tests such as repeat blood tests.
The Fixed Quotation we provide will include the consultant anaesthetist’s fees if appropriate. Purity Bridge will collect those fees as an agent for the consultant anaesthetist who is an independent practitioner.
Your consultant surgeon is an independent practitioner from Purity Bridge.
Nicotine use and surgery:
Nicotine, whether in the form of smoking, vaping or other forms, can have significant repercussions in many plastic surgery operations, particularly those that involve re-shaping or lifting (such as facial, breast and abdominal or body procedures). These include a significantly increased risk of wound healing and infection-related complications as well as risks of skin death, fat necrosis and nipple death in breast operations.
Therefore if you are a nicotine user, it is imperative for you to have stopped nicotine intake for three months prior to your surgery. As a matter of routine, a nicotine test is performed prior to any surgery at Purity Bridge, both at the pre-operative nurse appointment and on the day of surgery. If either of these is positive for nicotine, your surgery will be cancelled. Please be aware that passive smoking can sometimes lead to positive tests (e.g. sitting next to a smoker in the car).
There are financial consequences in these situations – if the test is positive on the day of surgery, you will lose 100% of the fees paid, as significant expenditure will already have been incurred by both Purity Bridge and your surgeon. If you test positive at the pre-operative nurse appointment (around 1-month prior to surgery), your surgery date will be rescheduled and you will lose the deposit you have paid, i.e. when re-booking a date for surgery you will need to pay the deposit again.
There are some select surgeries that can still proceed provided your consultant has agreed this. However, the risks associated with healing and anaesthetic problems remain higher than if you were not smoking or taking nicotine. Should such a complication occur that may have been preventable by stopping nicotine as recommended, you may be liable for any additional treatment costs. You must also not assume that your surgery falls into this category unless your consultant has explicitly stated this.
Liability:
- Please do not bring any valuable items into Purity Bridge. We will not accept liability for any loss or damage to any personal items or valuables left with us.
- We have in place complaints procedures which will apply to any complaints you may raise – please ask for more details if required.
- All of our consultants and independent medical practitioners are self-employed and provide their services direct to you and not on our behalf or that of Purity Bridge. The consultant/practitioner remains fully liable to you for your medical care and we will not be liable to you for their care, treatment, advice or practice.
- Notwithstanding any other provisions of these Terms & Conditions, we do not limit or exclude our liability for any death or personal injury caused by our negligence, or which cannot be excluded or limited by law.
Treatment:
What is included
- Post-operative facility fees incurred related to the procedure, as clinically required in relation to your original procedure.
- Clinic services, e.g. nursing services, operating theatre charges.
- Charges for the agreed prosthesis (where your procedure involves any prosthesis, e.g. a breast implant) as outlined in the itemised Fixed Quotation.
- Drugs and other materials used on the day of your procedure.
- Additional costs necessary to provide your treatment, e.g. hire of specialist equipment or instruments.
- Outpatient treatment that you may require following your procedure, such as removal of sutures.
- Any re-admission to Purity Bridge for medical complications arising from the original procedure, subject to following post-operative recommendations as set out by your consultant.
- Refreshments provided on the day of your procedure.
What is not included:
- Your consultant’s or any other healthcare professional’s fee for the initial outpatient consultation.
- Further charges incurred in the event of requiring transfer out to a 3rd party hospital or facility (private or NHS).
- Further laboratory fees incurred, such as pathology or histology (these will appear separately in your quote).
- Further costs incurred due to re-admission to Purity Bridge for medical complications arising from the original procedure due to disregarding your consultant’s post-operative recommendations.
- Fees for outpatient consultations before your surgery, which will be invoiced to you directly by your consultant unless otherwise specified. These prices are set directly by your consultant.
- Replacement prostheses as required.
- Any care or treatment provided anywhere other than Purity Bridge.
- Any long-term care, treatment or care that is not related to the Fixed Quotation procedure.
- Convalescence, treatment, accommodation or meals following discharge from Purity Bridge.
- Ambulance fees.
- Any revision procedure which is not clinically required (clinically required means where further intervention and/or monitoring of your condition is deemed medically necessary as a direct result of the original surgical intervention).
- Provision of any of the above will be charged separately to you at Purity Bridge’s standard rates and you will be responsible for payment of those charges.
- • Please note that any medical treatment not related or connected with the care and treatment identified at your pre- assessment, which requires a separate pathway of care, or is not clinically required, whether or not carried out at Purity Bridge is not included in the Fixed Quotation.
Revision surgery policy for aesthetic plastic surgery:
If your aesthetic surgery outcome does not match your consultant’s expectations as outlined to you, revision surgery may be provided free of charge (subject to approval of the director of Purity Bridge), provided this is identified by you or your consultant to us within six months of your initial admission. If the cosmetic result of your surgery meets the consultant’s expectation as outlined to you, any revision surgery will be chargeable at Purity Bridge’s and the consultant’s standard rates.
International patients:
By signing a Registration Form and agreeing to these Terms & Conditions you confirm that you have the necessary documentation to enter the UK and that you meet all relevant immigration criteria. You also confirm that you have made adequate arrangements to pay for your care.
Our services and information we need from you:
While Purity Bridge and your consultant always do their best to meet your expectations and ensure a satisfactory outcome, we cannot guarantee the result of any procedure, care or treatment, and it is possible that complications with your treatment or surgery can occur. Your consultant will explain these to you before your treatment.
We will need certain information from you that is necessary for us to provide the Services, and this can be asked for by anyone involved in your care or treatment, including by our staff at Purity Bridge, by your consultant or other medical professional or in your treatment letter. If, after being asked by us, you do not provide us with this information, or you provide us with incomplete or incorrect information, we may not be able to provide you with a full range of Services, meaning that you may be unable to be seen at Purity Bridge. Of course, if we are unable to provide the Services to you, you do not have to pay for the Services that we have not provided, but this does not affect your obligation to pay for any invoices we have already sent you for any Services we have already provided. Any advance payment you have made for Services that have not been provided will be refunded to you.
Consultants:
While at Purity Bridge, you will be under the care of the consultant you have been referred to, who may also involve other consultants in your care, if appropriate. Purity Bridge staff, including nurses, will provide your care under your consultant’s instructions.
Your consultant will have an agreement with Purity Bridge to quote for the current standard facility charges.
Your consultant and their secretarial staff do not have authority from Purity Bridge to alter the current standard facility charges. Any hospital prices mentioned by them are subject to written confirmation by Purity Bridge.
Events outside our control:
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms & Conditions that is caused by an event outside our reasonable control. If an event outside our reasonable control takes place that affects the performance of our obligations under these Terms & Conditions we will contact you as soon as reasonably possible to notify you, and our obligations under these Terms & Conditions will be suspended and the time for performance of our obligations will be extended for the duration of the event outside our reasonable control.
You may cancel the contract if an event outside our reasonable control takes place and the Services are delayed by more than 30 days and you no longer wish us to provide the Services. Please see your cancellation rights above.
The Contract:
These are the Terms & Conditions on which we supply Services to you, and along with the Fixed Quotation, form the contract for Services between you and us (the Contract). By signing this Form, you agree to these Terms & Conditions and the formation of the Contract.
The Contract is between you and Purity Bridge. No other person shall have any rights to enforce any of its terms. The Contract is governed by English law. You and we both agree to submit to the non-exclusive jurisdiction of the English courts.
If there is any conflict between these Terms and your Fixed Quotation, these Terms will take precedence. If there is any conflict or inconsistency between any marketing materials and the Contract (which together form the contract between you and us) the Contract will take precedence.
We may transfer our rights and obligations under these Terms & Conditions to another organisation, and we will always notify you in writing if this happens, but this will not affect your rights or our obligations under these.
Even if we delay in enforcing the Contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under the Contract, or if we delay in taking steps against you in respect of your breaking the Contract, that will not mean that you do not have to do those things or prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the Services, we can still require you to make the payment at a later date.
If a court finds part of the Contract illegal, the rest will continue in force. Each of the paragraphs of these Terms & Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Acknowledgement:
1.I agree to the above outlined Terms & Conditions provided to me by Purity Bridge.
2.I agree to pay for any and all services provided by Purity Bridge in accordance with the Terms & Conditions set out above. I also agree to pay for any and all charges levied as detailed above that are not included in the Fixed Quotation.
3.If a 3rd party or insurer has agreed to pay my account or part of my account, I agree to pay any balance outstanding if the 3rd party or insurer does not pay the account in whole or in part.
4.I understand the nature and consequence of my personal data being processed and disclosed as set out by the Purity Bridge Privacy Policy (which can be found on the Purity Bridge website, (www.puritybridge.co.uk).
5.Purity Bridge reserves the right to assign to a 3rd party any outstanding debts or accounts due to Purity Bridge for the purposes of recovery of the same by that 3rd party.
